Technically, Hillary Clinton shouldn’t really be allowed to be secretary of State, because the Constitution’s Emoluments Clause says that members of Congress can’t serve in a government position whose salary (emolument) had been increased during their current term, and the secretary of State got a pay boost while Clinton served in the Senate. But, in a move known as a Saxbe fix, Congress revoked the pay raise in order to fall in line with the spirit of the Constitution, if not the letter. So nobody really cares that, technically, this might be unconstitutional except the conservative group Judicial Watch, which has tried to challenge Clinton’s appointment in court. But the Supreme Court dismissed the suit today, and if they don’t care, then it’s probably not a big deal.
