Republicans Indicate Kagan Could Still Face Filibuster

According to Senate Minority Leader Mitch McConnell, there is still a possibility that Supreme Court nominee Elena Kagan will have to overcome a filibuster, despite the Kentucky senator’s claim over a month ago that the chance of Republicans causing such an obstacle would be “highly unlikely.”

I think some of her views are quite troubling, at least to me, in the area of political speech and the First Amendment,” he said on Fox News Sunday. “I think it’s entirely too early to determine whether or not this nominee would be subjected to a 60-vote threshold.”


Kagan’s Senate Judiciary Committee confirmation hearing is set to begin a week from Monday, which Republican panel member Jeff Sessions has griped is not enough time for senators and staffers to review the nearly 200,000 Kagan-related documents released in recent weeks. Or maybe they just need more time to figure out what they’re actually going to argue.
