Adding insult to alleged injury, plaintiff Frank Sullivan (for Rude Music, Inc., the copyright holder), the founding member of the band Survivor, noted Gingrich’s own recent remarks on copyright in the complaint. “We have a patent office, we have a copyright law,” the complaint attributed to Gingrich. “If a company finds that it has genuinely been infringed upon, it has a right to sue … “ According to Rude Music, Gingrich has used the song without permission numerous times during his campaign and at appearances over the past three years.
