A federal judge rejected the city’s request yesterday that she throw out a case against the NYPD that claims the department uses race as a factor for their “stop and frisk” tactics. The lawsuit, which alleges that the “widespread pattern and practice of suspicion-less and race-based” searches is unconstitutional, will be allowed to proceed based on statistical evidence and NYPD “roll call recordings” secretly taped by officer Adrian Schoolcraft.
